These Terms and Conditions explain the agreement between you and Ambiance Artist LLC for purchases and services provided through ambianceartist.com. Our services may include seasonal decorating, event design, planning, styling, sourcing, delivery, indoor or outdoor installation, and removal. In these Terms, “Ambiance Artist,” “we,” “us,” and “our” mean Ambiance Artist LLC. “You” and “your” mean the customer who places or authorizes the order.

1. Agreement to These Terms

To place an order, you must be at least 18 years old. By checking the agreement box at checkout and completing your purchase, you agree to these Terms and enter into a contract with Ambiance Artist LLC. The version of the Terms shown at checkout applies to your order.

You must have permission to approve the installation at the property you provide. If you place an order for someone else or for a property you do not own, you confirm that the property owner, property manager, or another authorized person has given you permission.

2. Services and Package Details

Ambiance Artist provides seasonal decorating and event design, planning, and styling services for homes, businesses, parties, and other occasions. Depending on your order, our services may include design, sourcing, delivery, indoor or outdoor setup, installation, styling, and removal.

Your order includes only the services, products, quantities, areas, and add-ons shown in the package description and order confirmation. Anything not listed is not included. Additional requests are subject to availability and may require an additional charge, which we will disclose before adding it.

Candle-style lighting will be battery-operated unless your order specifically includes real candles. Real candles are provided and arranged unlit. We do not light or supervise open flames. If real candles are lit, the customer is responsible for permission, supervision, safe use, and extinguishment.

3. Orders, Pricing, and Payment

All orders must be placed and paid in full through ambianceartist.com. We do not accept deposits or collect payments at the property. An order is confirmed only after the payment is successfully processed and we send an order confirmation.

All prices are shown in U.S. dollars. The total displayed at checkout will include applicable taxes and any disclosed delivery, travel, or optional add-on charges. This is the amount you authorize us to charge. We will not add another charge without first disclosing it and receiving your approval.

You must provide complete and accurate contact, billing, property, and access information. We may decline or cancel an order because of service-area limitations, scheduling capacity, product availability, a pricing or technical error, payment or fraud concerns, or incomplete or inaccurate information. If we cancel an order before providing any services, we will notify you and refund the amount charged.

4. Cancellations and Refunds

You may cancel an order for a full refund by submitting a written cancellation request within 24 hours after the order is placed. The 24-hour period runs continuously from the exact time of purchase and includes weekends and holidays. Your request must include your name and order information and must be sent through the contact method listed on our website.

After the 24-hour cancellation period expires, all sales are final and nonrefundable. We begin reserving scheduling capacity, planning the design, coordinating labor and delivery, and sourcing products as soon as an order is received. This policy still applies if your travel, event, occupancy, or other personal plans later change.

If Ambiance Artist cancels an accepted order and cannot provide the service during a reasonably suitable alternative time, we will refund the amount paid for the portion of the service we do not provide. Approved refunds will be returned to the original payment method. The time required for the refund to appear in your account will depend on your bank or payment provider.

5. Scheduling

The service date, installation week, or setup window selected during checkout will be shown in your order confirmation. Unless the order confirmation guarantees an exact date or arrival time, selecting a week or service window does not create an exact appointment.

We determine exact scheduling based on route planning, crew and product availability, property or venue access, weather, road conditions, and other circumstances affecting the service. We will send scheduling details and important changes using the contact information provided with your order. Arrival windows are estimates and may change during the day.

You generally do not need to be present for an exterior installation if the area is safely accessible and we have the necessary instructions. For an interior or venue installation, you or an authorized representative must be present unless we approve another access arrangement in writing.

6. Customer Changes and Rescheduling

If you need to change your service date, installation week, location, or requested services, you must contact us in writing as soon as possible. Changes and rescheduling requests are subject to our service area, scheduling capacity, crew availability, and product availability and are not guaranteed.

Seasonal installations may be moved only to another available time within the same season. Other date changes must be approved by Ambiance Artist. An approved change may affect the price or require additional delivery, travel, product, or labor charges. We will disclose any additional charge and receive your approval before adding it.

A change or rescheduling request does not restart or extend the 24-hour cancellation period and does not create a right to a refund. If we cannot accommodate the requested change, the cancellation and refund policy in Section 4 will continue to apply.

7. Property and Venue Access

By placing an order, you give Ambiance Artist and our employees or contractors permission to enter the areas of the property or venue reasonably needed to deliver, set up, install, document, service, or remove the items included in your order. You must obtain any required permission from the property owner, landlord, property manager, homeowners association, or event venue before our arrival.

You must provide accurate gate codes, entry instructions, parking or loading information, and any property or venue rules that may affect our work. You must also secure pets, remove vehicles or other obstructions when necessary, and provide a reasonably clear and safe working area.

You must tell us about known hazards, fragile or porous surfaces, unstable stairs, delicate landscaping, irrigation or sprinkler systems, restricted areas, and any rules limiting how decorations may be placed or secured. If we cannot safely or lawfully access the work area, we may pause the work and attempt to reschedule if availability permits. Failure to provide the required access does not create a right to a refund. Any return-trip or additional-service charge will be disclosed and approved before it is added.

8. Weather, Safety, and Events Beyond Our Control

Our work may be delayed, interrupted, changed, or rescheduled because of severe weather, unsafe roads or surfaces, wildfire, property or venue closures, utility outages, government restrictions, product shortages, transportation interruptions, emergencies, or other circumstances beyond our reasonable control. Ambiance Artist will determine whether working conditions are safe.

We may refuse, pause, move, or modify any placement or installation method that appears unsafe, unlawful, blocks an entrance, walkway, or emergency exit, involves a prohibited open flame, or violates property or venue rules. When possible, we will preserve the overall design while making the work safe.

We will make reasonable efforts to complete the service at another suitable time when circumstances allow. A delay, change, or rescheduling caused by these conditions does not create a right to a refund. If circumstances beyond our reasonable control make it impossible to complete the service, we will refund the amount paid for the portion we were unable to provide.

9. Natural Materials, Variations, and Substitutions

Pumpkins, gourds, flowers, plants, greenery, hay, straw, and other natural materials will vary in color, size, shape, weight, texture, pattern, bloom, and surface appearance. Minor imperfections and natural differences are expected and are not defects. Colors may also appear different in photographs or on different screens.

Specific varieties, colors, sizes, and seasonal materials are subject to availability. When necessary, we may use a reasonably comparable substitution without prior notice while preserving the order's overall style, stated minimum quantities, sizes or weights, scale, quality, and value. We will not knowingly substitute materials in a way that creates a materially smaller or lower-value design.

Natural variations and reasonable substitutions that follow this section do not qualify for a refund or replacement.

10. Design Images and Final Results

Images shown on our website, social media, portfolio, or other materials are examples of the intended style, color direction, abundance, and general composition of our work. They are not exact blueprints or guarantees that every item will be placed in the same position.

Every design is adapted to the property or venue, available space, architecture, surfaces, access, safety requirements, and available materials. By purchasing a package, you give Ambiance Artist reasonable creative discretion over the placement, layering, and final composition of the design.

Creative discretion does not allow us to reduce the listed quantities, stated minimum sizes or weights, overall quality, or value of your order. Requests beyond the selected package may require an additional charge, which we will disclose and receive your approval before adding.

11. Care and Product Lifespan

Pumpkins, gourds, flowers, plants, greenery, and other natural materials are perishable. We do not guarantee that they will remain unchanged or last for a specific number of days. Their condition may be affected by temperature, frost, sunlight, rain, moisture, drainage, sprinklers, wildlife, insects, pets, and other environmental conditions.

After installation, you are responsible for following any care instructions, performing ordinary maintenance such as watering live plants or replacing batteries, and monitoring the display. You must remove or safely reposition any item that becomes soft, leaking, moldy, unstable, damaged, or likely to create a safety or property risk.

Ambiance Artist is not responsible for ordinary deterioration or for damage caused after installation by weather, animals, sprinklers, theft, vandalism, guests, contractors, customer handling, or movement of the display. These conditions do not qualify for a refund or replacement. This does not apply to an item or service that was missing, incorrect, or materially damaged at the time of completion and was properly reported under Section 14.

12. Completion, Ownership, and Responsibility

Unless your order includes ongoing event support or another continuing service, our work is complete when the ordered design has been delivered, installed, and styled at the property or venue. We may document the completed work for quality and business records.

Ownership depends on the type of item and what is stated in the package description or order confirmation. Pumpkins, gourds, flowers, plants, hay, straw, and similar natural materials supplied as part of an outdoor seasonal package become the customer's property when the service is completed unless the order states otherwise.

Reusable décor used for interior or event installations — including battery-operated candles, candle holders, lanterns, vessels, stands, textiles, and decorative accents — remains the property of Ambiance Artist and is provided temporarily unless the order specifically states that the item is included for the customer to keep. The package description or order confirmation will control the ownership of door décor and any other item not specifically addressed in this section.

After completion, the customer is responsible for protecting the display and any Ambiance Artist property left at the property or venue. Company-owned items must not be discarded, sold, altered, or removed from the property without our permission and must be made available for scheduled pickup. The customer may be responsible for the reasonable replacement cost of a company-owned item that is lost, discarded, or damaged while in the customer's care, except for ordinary wear or damage caused by Ambiance Artist.

13. Removal, Breakdown, and Pickup

Removal of an outdoor or seasonal display is included only when the package description or order confirmation states that it is included or when removal is purchased as an add-on.

Before a scheduled removal, we will confirm which customer-owned items you want to keep and which items you want us to remove. This may include pumpkins, gourds, flowers, plants, hay, door décor, and other materials included in the display. Items you choose to keep will be left at the property. Items approved for removal may be discarded, donated, composted, or otherwise handled by Ambiance Artist and may not be recoverable afterward.

Pickup and breakdown of rented or company-owned interior or event décor is part of the service and does not require a separate removal add-on unless the order confirmation states otherwise. Before pickup, we will confirm whether any customer-owned or consumable items should remain at the property. Pumpkins and other natural materials may be left for the customer when requested, while rented or company-owned candles, candle holders, lanterns, and other reusable décor will be collected.

Pickup of rented or company-owned items used in an outdoor or seasonal display does not include removal of the remaining customer-owned display unless removal is included in the order or purchased as an add-on.

For any scheduled removal, breakdown, or pickup, you must provide safe access to the property or venue. Unless we agree otherwise in writing, we will handle only items supplied by Ambiance Artist. The service includes reasonable light cleanup of loose installation debris but does not include deep cleaning, stain or wax removal, property repairs, moving unrelated items, or removing decorations supplied by the customer or another company. Any additional work or charge must be disclosed and approved before it is added.

Pumpkins and other natural materials are supplied for decorative purposes. Ambiance Artist does not guarantee that they are suitable for eating or any other use after being displayed.

14. Order Concerns and Corrections

A missing item or service, incorrect package or quantity, or item that was materially damaged when delivered must be reported in writing within 24 hours after the service is completed. If you do not report one of these concerns within 24 hours, the order will be considered accepted as delivered, and the concern will not qualify for a correction, replacement, or refund under this section.

Property damage allegedly caused by our team must be reported promptly after it is discovered. A time-sensitive concern involving a party or event must be reported immediately. If a concern is not reported in time for us to address it before the event, we are not responsible for our inability to correct it before the event begins.

Your report must include your name, order information, a clear description of the concern, and photographs when reasonably possible. You must give us a reasonable opportunity to inspect and correct the problem before changing or removing the affected part of the display or hiring someone else to correct it, unless immediate action is necessary for safety.

If we confirm that Ambiance Artist is responsible, we will provide an appropriate solution. Depending on the problem, this may include correcting the arrangement, providing a reasonably comparable replacement, completing an omitted part of the service, or refunding a reasonable amount for the affected part of the order.

Natural variations, substitutions permitted under Section 9, and personal design preferences do not qualify as problems when the completed work otherwise matches the purchased package and Section 10. Ordinary deterioration and damage caused after completion are governed by Section 11 and are not covered by this section. Nothing in this section limits a right or remedy that applicable law does not allow us to limit.

15. Photography and Marketing

We may photograph or record the completed work area to document the service, confirm completion, review quality, and maintain business records. We will make reasonable efforts to focus on the decorated area and avoid unnecessary personal or identifying information. These records will not be used publicly unless marketing permission has been provided.

We may use photographs or videos of the completed design on our website, social media, advertising, or portfolio only when the customer gives permission through a separate option at checkout or otherwise in writing. Marketing permission is optional and is not required to place an order. If you authorize marketing use at a property or venue you do not own, you confirm that you have permission to provide that authorization. No payment or other compensation is provided for authorized marketing use.

We will not intentionally publish a street address, visible house number, license plate, or identifiable person without separate permission. You may withdraw marketing permission at any time by contacting us in writing. Withdrawal applies only to new marketing materials created after we receive your request. It does not require us to remove, recall, alter, or destroy materials already created, posted, published, printed, distributed, scheduled, or placed into production, unless required by law.

16. Limits on Liability

Ambiance Artist will use reasonable care while working at a property or venue. We are not responsible for pre-existing property conditions, hazards or restrictions that were not disclosed to us, or loss or damage caused after completion by the customer, guests, venue staff, contractors, or other third parties.

To the fullest extent permitted by law, Ambiance Artist is not liable for indirect, incidental, special, punitive, or consequential losses arising from an order or service. This includes lost income or profits, travel expenses, business interruption, loss of use, loss of enjoyment, or costs charged by another person or business.

To the fullest extent permitted by law, our total liability for a claim will not exceed the amount paid to Ambiance Artist for the order connected to that claim, whether the claim is based on contract, negligence, or another legal theory. This limit does not apply to gross negligence, intentional misconduct, or any liability or consumer right that applicable law does not allow us to limit.

17. Intellectual Property, Website Use, and Privacy

The Ambiance Artist name, logo, package names, website content, original photographs and videos, written descriptions, graphics, and other original materials are owned by Ambiance Artist or used with permission and are protected to the extent allowed by law. You may view and use our website to learn about our services and place an order, but you may not copy, reproduce, republish, sell, or commercially use our protected materials without written permission.

You may photograph and share your own completed display on personal or business social media. However, you may not use our website images or materials to advertise another company, falsely claim our work as your own, or reproduce and sell our designs as a competing service. You may not misuse the website, interfere with its operation or security, introduce harmful software, or use automated tools to copy its content.

Personal information submitted through the website is handled according to the Ambiance Artist Privacy Policy published on our website. Payment processors and other technology providers may also process information under their own terms and privacy policies.

18. Utah Law, Disputes, Updates, and Contact

These Terms and each order are governed by Utah law. Before filing a lawsuit, you and Ambiance Artist agree to send written notice of the dispute and make a good-faith effort to resolve it directly for at least 30 days. This requirement does not prevent either party from using small-claims court, requesting urgent legal relief, or taking action needed to meet a legal deadline. An unresolved dispute may be brought in a court with proper jurisdiction in Utah unless applicable law requires otherwise.

These Terms, the package description presented at the time of purchase, the order confirmation, and any changes separately approved in writing form the complete agreement for the order. If they conflict, the order confirmation controls the package, quantities, price, location, service date or window, and purchased add-ons. These Terms control the general policies.

If any part of these Terms is found invalid or unenforceable, the remaining parts will continue to apply. If either party does not enforce a provision on one occasion, that does not waive the right to enforce it later.

We may update these Terms for future purchases by posting a revised version and effective date on our website. The version accepted when an order is placed will continue to apply to that order. A later update will not change an existing order unless both parties agree or the change is required by law.
